The 9th U.S. District Court of Appeals will hear arguments in the Prop 8 case starting on December 6th. There will be a three member panel of judges chosen for the case, and their names have not yet been made known.
Should the court feel the case has merit, they will hear it out and then decide whether to appeal Judge Walker’s decision which overturned Prop 8 and legalized same sex marriage in the state of California. If the court overturns Walker’s ruling, then the case is fully expected to be taken to the Federal Supreme Court.
The other possibility is the 9th Circuit Court will find there is not enough validity to the appeal and refuse to hear it. If that is the case then same sex marriage will become legal in the state of California on a permanent basis.
